- Senior Discrimination Investigator
Description
This position ensures legal and policy compliance with the department’s obligation to provide timely and effective responses to both internal and external complaints of workplace discrimination, reprisal and discriminatory harassment by conducting complex investigations, handling complex matters, including overlap with FMLA, Worker’s Compensation law, contractual bargaining rights, and undue hardships. This position is also responsible for writing and reviewing workforce policies and ensuring adherence to current case law, regulatory guidance and statutory requirements under various state and federal laws including: Title VII of the Civil Rights Act, the Equal Pay Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Minnesota Human Rights Act, State Personnel Management, Minn. Stat. Chapter 43A, the Minnesota Government Data Practices Act, Minn. Stat. Chapter 13, FHWA Civil Rights laws, relevant rules of Civil Procedure, and all related MnDOT internal policies.
The incumbent serves as MnDOT’s primary contact for discrimination-related matters and confers regularly with the Minnesota Attorney General’s Office and Minnesota Management and Budget regarding internally and externally filed complaints of discrimination, as well as lawsuits filed in state and federal court. Additionally, the position provides legal counsel to managers and Human Resources and manages key aspects of the department’s statewide internal complaint process, including recommending informal resolution methods (e.g., mediation) referring cases; determining investigative strategies and processes; hiring and directing contractors to conduct expert discrimination investigations; drafting comprehensive investigative reports; and making findings and recommendations for appropriate follow-up.

Requirements
Minimum Qualifications:
Three years of advanced professional experience applying state and federal non-discrimination law in the public sector that demonstrates the following:
- Performing complex legal and case analysis
- Conducting all aspects of complaint investigations, including drafting investigative reports and findings, and providing follow-up guidance to management
- Responding to discrimination complaints
NOTE: A Juris Doctor degree from an American Bar Association accredited law school substitutes for one year of advanced professional experience.
